1. General principle

The products sold on cocinasfagosa.com are covered by the legal guarantee of conformity applicable to consumers.

The legal guarantee cannot be excluded or limited to the detriment of the consumer.

2. Duration of the legal guarantee

For new products, the legal guarantee of conformity is 3 years  from the delivery of the product.

For second-hand, refurbished, restored or display products, a shorter period may be agreed upon when permitted by law, but never less than the applicable legal minimum.

If a shorter period for second-hand products is not expressly agreed, the general corresponding period will apply.

3. Lack of conformity

A product may be considered non-conforming when:

  • it does not match the description;
  • it does not possess the advertised qualities;
  • it is not fit for the usual purpose of goods of the same type;
  • it is not fit for a specific purpose communicated by the customer and accepted by the Seller;
  • it is not delivered with advertised accessories, instructions or elements;
  • it has defects existing at the time of delivery.

4. Consumer rights

In case of lack of conformity, the customer may request:

  • repair;
  • replacement.

When repair or replacement are impossible, disproportionate, not carried out within a reasonable period, or cause significant inconvenience to the consumer, the consumer may request:

  • price reduction;
  • termination of the contract, where legally applicable.

5. Display, outlet, restored or reconditioned products

When a product has particularities, marks, visible wear, variations or aesthetic defects informed before purchase, these characteristics will be taken into account when assessing conformity.

Characteristics clearly communicated in the product sheet will not automatically be considered a lack of conformity.

6. Commercial guarantee

Unless expressly indicated in the product sheet or in a specific document, Cocinas Fagosa. does not offer an additional commercial guarantee other than the legal guarantee.

Any commercial guarantee, if offered, does not replace or limit the legal guarantee.

7. How to request warranty assistance

For warranty requests, the customer must write to:

info@cocinasfagosa.com

The message should include, where possible:

  • order number;
  • product name;
  • description of the problem;
  • product photographs;
  • packaging photographs, if applicable;
  • any useful information.

8. Costs

When the defect is covered by the legal guarantee, the costs necessary to manage the guarantee will not be borne by the customer.

The customer must not send bulky furniture without first contacting customer service.
